Marital rape exception violates fundamental rights: Delhi HC

Delhi high court has been told that the marital rape exception takes away the right of a married woman to say no. The counsel appearing for petitioner NGOs RIT Foundation and All India Democratic Women’s Association argued on Wednesday that the exception took away a class of human beings, i.e. husbands of adult wives, out of the ambit of the offence of rape, and the same couldn’t be permitted.
