House arrest curtails liberty, must be part of custody period: HC
The Bombay High Court released alleged hawala operator Mohammed Farooq Shaikh on bail, stating that house arrest curtails a person's liberty. Shaikh has already spent a substantial part of the sentence prescribed for money laundering in custody. The court disagreed with the ED's argument that the period of house arrest should not be considered in computing Shaikh's total custody period. Shaikh has been in custody for over five years and eight months for an offence with a maximum punishment of seven years. The court directed his release on a Rs 1 lakh personal bond.
